Legal Proceedings

May 2022DOJ civil complaint filed
U.S. District Court, Western District of Virginia
Alleged systematic AWA violations: veterinary care failures, housing deficiencies, improper euthanasia, unqualified personnel. Federal search warrant executed.
DOJ enforcement of the AWA is rare — filing signaled extraordinary circumstances.
Jul 2022Consent decree entered
U.S. District Court, Western District of Virginia
Authorized surrender of all dogs. Established conditions for facility wind-down. Enabled HSUS-coordinated rescue of ~4,000 beagles.
Converted enforcement action into rescue operation.
2023Guilty plea
Federal court
Envigo pleaded guilty to: (1) conspiracy to violate the Animal Welfare Act, and (2) felony conspiracy to violate the Clean Water Act.
Criminal conviction. CWA felony indicates environmental contamination beyond animal welfare.
2023$35M penalty imposed
Federal court
Largest fine in AWA history. Compliance monitoring imposed on Inotiv. Permanent prohibition on licensed activity at Cumberland.
Penalty exceeded total revenue from dog sales (~$16M from ~15,000 dogs).

Corporate Liability Chain

The Cumberland facility passed through four corporate owners over six decades. Each acquisition transferred the assets — and the compliance obligations — to a new parent. When Inotiv acquired Envigo in November 2021, it inherited a facility already under USDA scrutiny.

Key Finding
Inotiv paid ~$592M for Envigo and inherited $35M+ in penalties within two years. The USDA violations were accumulating before the acquisition closed — raising questions about due diligence in laboratory animal breeding acquisitions.
